Validity of the GTC
- These General Terms and Conditions apply as a contract for the rental of the vacation apartment in Oberrüti for accommodation as well as all other services and deliveries provided to the guest by the Köppel family.
The services of the Köppel family are provided exclusively on the basis of these General Terms and Conditions.
- The subletting or re-letting of the rented vacation apartment is not permitted.
- The guest’s terms and conditions shall only apply if these have been agreed in advance.
Deviations from these terms and conditions are only effective if this has been expressly confirmed in writing.
- 1 Definitions
- The term “Oberrüti vacation apartment” refers to the granny apartment in the single-family house of the Köppel family, address: Rebenweg 20, 5647 Oberrüti, Switzerland.
The owner of the vacation apartment is the Köppel family.
- The term “Köppel family”, “we”, “us” or “our” refers to the owners of the Oberrüti vacation apartment: Anne-Sophie and Edoardo Köppel, residing at Rebenweg 20, 5647 Oberrüti, Switzerland.
- 2 Booking/booking confirmation
- All booking inquiries must be made via our website ferienwohnung-oberrueti.ch, by e-mail [email protected] or by telephone on +41 76 244 50 28.
All requests made via any other method will not be considered.
- If we can offer you the apartment in your desired period, we will send you a written confirmation by e-mail.
Your booking is legally binding upon receipt of the booking confirmation.
- 3 Terms of payment
- Payment is usually made when booking on our homepage using our payment tool.
In exceptional cases, we will authorize payment on arrival or we will issue an invoice.
If the payment deadlines are not met, we can withdraw from the contract.
Non-payment is deemed to be a withdrawal and entitles you to re-let. - Additional costs for water, heating, parking space, electricity, WLAN and waste disposal are included in the rental price and are therefore not charged additionally.
- 4 Arrival and departure
- The apartment is available from 14:00 on the day of arrival.
The guest will receive information about the handover of keys by e-mail 5 days before arrival.
Claims for damages cannot be asserted if the vacation apartment cannot be occupied punctually at 2 p.m. as an exception.
- On the day of departure, the apartment must be vacated by 10:00 am.
If the guest wishes to leave late, this should be agreed with us in advance.
A late departure without prior agreement will be charged.
- If the guest does not show up by 23:30 on the day of arrival without prior notification, the contract shall be deemed terminated after a period of 24 hours without notification to Ferienwohnung Oberrüti.
Ferienwohnung Oberrüti or the Köppel family can then freely dispose of the property.
A (pro rata) refund of the rent due to early departure will not be made.
- The apartment must be left swept clean on the day of departure.
The dishes, glasses, etc. must be cleaned and put away and the refrigerator should be emptied.
If the apartment is left in a disproportionately dirty and messy condition, you may be charged for this.
- 5 Holiday apartment
- The apartment will be handed over by us in a clean and tidy condition with a complete inventory.
Should you notice any major defects during your stay, the guest is obliged to inform the Köppel family immediately.
The guest is liable for any damage caused to the rented property, the inventory, e.g. broken crockery, damage to the floor or furniture.
This also includes the costs for lost keys.
- The inventory is to be treated with care and is only intended for use in the vacation apartments.
Moving furnishings, in particular beds, is prohibited.
The guest is also liable for the fault of fellow travelers.
Damage caused by force majeure is excluded from this.
If the vacation apartment is used in breach of contract, such as subletting, overcrowding, disturbance of the peace, etc., the contract can be terminated without notice and the guest must leave the vacation apartment.
The rent already paid remains with the Köppel family.
- 6 Pets
- Pets of any kind are not permitted in the vacation apartment.
- 7 Stay
- The apartment may only be used by the persons listed in the booking.
If the apartment is used by more persons than agreed, a separate fee of CHF 100 per person/per night must be paid.
In this case, the Köppel family also has the right to terminate the contract without notice.
- Subletting and transfer of the apartment to third parties is not permitted.
The guest agrees to the general terms and conditions as well as the house rules of the apartments.
The declaration of consent is made with the payment.
- The Köppel family is entitled to terminate the tenancy immediately and without notice in the event of breaches of the GTCs or the house rules.
There is no legal entitlement to repayment of the rent or compensation.
- 8 Trip cancellation
- In the event of cancellation, the guest is obliged to pay part of the agreed price as compensation.
Cancellation must be made in writing.
The amount of compensation depends on the time until the day of arrival and is calculated as follows: - Cancellation is possible free of charge at least 14 days before arrival
- from 13 days to 8 days before the day of arrival 50 % of the confirmed total price
- from 7 days to the day of arrival 100 % of the confirmed total price
- 100 % of the agreed total price in the event of no-show
- 9 Withdrawal by the landlord
- In the event of cancellation on our part, as a result of force majeure or other unforeseeable circumstances (such as accident or illness of the host) as well as other circumstances for which we are not responsible and which make fulfillment impossible, liability is limited to the reimbursement of costs.
In the event of justified withdrawal, the customer is not entitled to compensation – no liability is assumed for travel and hotel costs.
- The Köppel family may withdraw from the contract after the start of the rental period without notice.
- 10 Liability of the landlord
- The Köppel family is liable for the proper provision of the rental property within the scope of its duty of care.
Liability for any breakdowns or faults in the water or electricity supply, as well as events and consequences due to force majeure, are hereby excluded.
- 11 Permission to use Internet access via WLAN
- The Köppel family maintains Internet access via WLAN in their vacation apartment.
They allow the guest to share use of the WLAN access to the Internet for the duration of their stay in the vacation property.
The tenant does not have the right to allow third parties to use the WLAN.
- The Köppel family does not guarantee the actual availability, suitability or reliability of the Internet access for any purpose.
It is entitled at any time to allow other co-users to operate the WLAN in whole, in part or temporarily and to restrict or exclude the tenant’s access in whole, in part or temporarily if the connection is or has been used in violation of the law, insofar as the Köppel family must fear a claim for this reason and cannot prevent this with normal and reasonable effort within a reasonable period of time.
In particular, the Köppel family reserves the right to block access to certain sites or services via the WLAN (e.g. sites that glorify violence, pornographic or fee-based sites) at its reasonable discretion and at any time.
- 11.1 Access data
- Use of the WLAN is secured by means of access protection.
The access data (login and password or QR code) may not be passed on to third parties under any circumstances.
- If the guest wishes to grant third parties access to the Internet via the WLAN, this is subject to our prior written consent and the third party’s acceptance of the provisions of this user agreement, documented by signature and full identification.
- The guest undertakes to keep his access data secret.
- The Köppel family has the right to change access codes at any time.
- 11.2 Dangers of WLAN use, limitation of liability
- The guest is informed that the WLAN only allows access to the Internet, virus protection and firewall are not available.
- The data traffic generated using the WLAN is unencrypted.
The data may therefore be viewed by third parties.
- The Köppel family expressly points out that there is a risk that malware (e.g. viruses, Trojans, worms, etc.) can get onto the end device when using the WLAN.
Use of the WLAN is at the guest’s own risk.
- We accept no liability for damage to the tenant’s digital media caused by the use of Internet access, unless the damage was caused by us and/or our vicarious agents intentionally or through gross negligence.
- 12 House rules, general rights and obligations
- The guest is obliged to comply with the house rules.
From 22:00 to 07:00 the night’s rest applies.
To avoid disturbance, conversations, TV and audio equipment must be set to room volume.
- For the duration of the rental of the vacation apartment, the guest is obliged to keep windows (except tilted) and doors closed when leaving the vacation apartment.
- There is a general smoking ban in the apartment.
In the event of non-compliance, you may be charged a cleaning fee of up to CHF 500.00.
Smoking is only permitted on the terrace. - Our own parking lot offers 1 parking space.
Additional vehicles can be parked in the side streets of the residential area (visitor parking) at your own risk.
Please make sure that no vehicles obstruct the exit from our double garage. - The installation and/or attachment of materials for decoration or similar is not permitted in the vacation apartment.
The guest is solely liable for any decorations or the like that are nevertheless installed and/or attached.

When exercising the right of access, due consideration must be given to the guest’s legitimate interests.
We will inform the guest in advance about the exercise of the right of access, unless this is unreasonable or impossible in the circumstances of the individual case.
- When using the terrace or the garden around the terrace, the “Terrace Rules”, which are displayed on the door, must be followed.
- 13 Place of jurisdiction
- The district court of Muri is responsible for any disputes arising from the contractual relationship.
